Do you want to quit your job? Here's how to separate from your current company in Qatar

Resigning from your current job in Qatar requires a certain process that you need to follow enable for you to receive your end-of-service benefits and be cleared from any accountabilities in the company.

Resignation

According to Hukoomi, e-Government Portal, the employee is entitled to resign from his/her job. The authority concerned with the approval of the resignation is the same as the appointment authority, provided that the resignation is submitted in writing and does not include any condition or restriction, and mentions the date of the end of service.

The resignation request should be settled within 30 days as of its submittal, otherwise it will be considered as legally approved. However, the approval of the resignation request during this period may be postponed for a similar period for reasons related to the interest of work.

If the employee is referred to a disciplinary interrogation, his/her resignation shall not be approved before a decision is reached regarding the sanction to be imposed other than that of dismissal.

When is it permissible for you to terminate the employment contract?

You may terminate your employment contract whether fixed or indefinite while retaining your right to end of service benefits in the following cases:

- If the employer breaches his obligations under the contract, or violates the labor law.

- If you or a member of your family has committed an attack or an act that is contrary to morality.

- If the employer committed fraud in relation to the terms of the contract.

- If there is a serious risk to your safety or health, provided that the employer is aware of the existence of this danger but did not work to remove it.

The end of service bonus shall be awarded if the period of work is for a full year or more, and is due for the whole number of years of service, and this remuneration shall be determined by the parties, provided that it is not less than three weeks' wages for each year of service.

If you have finally decided to resign and have been cleared from your most recent company, then you are planning to shift to another job, read this for your reference:

Notify your current employer that you plan to terminate your contract and change job, through ADLSA’s electronic system. The period from the day you inform your employer until the day you leave is called the notice period. You have to continue working with your current employer during this time.

• If you have worked with the employer for two years or less, you have to notify your employer 1 month before leaving the job.

• If you have worked with the employer for more than two years, you have to notify your employer 2 months before leaving the job.

You also need to submit a form to change jobs through the electronic notification system of the Ministry of Administrative Development, Labour and Social Affairs (ADLSA), and attach the following 2 documents:

• Copy of your contract with former employer which has been attested by ADLSA

• Letter in Arabic from your new employer confirming your hiring and addressed to ADLSA.

What are the cases under which you are not able to apply for sponsorship transfer?

End of contract period without renewal means end of work you have come for, you must therefore leave Qatar, unless you are able to get consent from sponsor to renew your contract or transfer it to other work party. 

If you could not acquire this consent, you must leave the country so that you are not considered a violator of Qatari laws, and you may expose yourself to detention in “deportation centre”, as well as paying fines.

Escape from work or accommodation and working for others, (other than the sponsor), resulting in court ruling for your deportation from Qatar, or exposing you to administrative decision for deportation if this consisted a disturbance of general order.

Resignation by your own will or refraining from doing work without legal reason.

How long is the period during which you have to leave the country?

An expatriate shall leave if he does not obtain a residence permit.

He must also leave within ninety days if the residence permit is terminated, canceled for any reason, or the purpose for which he entered the country is not valid anymore.

Is it legal to end your contract if your health condition prevents you from reporting back to work after your maternity leave ends?

You may not be dismissed from work, but are considered on leave without pay, provided that your period of interruption is not more than sixty consecutive or disrupted days, provided that you submit a certificate of your medical condition from a specialist doctor accepted by the employer.

Maternity leave does not affect your right to other holidays.

May you end the labor contract before the end of its duration while safeguarding your full right to the end of service bonus?

Yes, you may, in any of the following cases:

- If an employer has not met hisIher obligations specified in the provisions of this law or in the labor contract.

- If an employer, or a person mandated by him/her, has cheated at the time of concluding a contract with a worker, with respect to the terms of employment.

- If an employer or a member of his/her family aggresses a worker, which harms the worker physically or his/her life.

- In the event of a serious danger which threatens a worker’s safety or health, provided that an employer was cognizant of the danger, and had not sought to remove it.
